University of Cali v Bakke

https://www.oyez.org/cases/1979/76-811

The school reserved sixteen places in each entering class of one hundred for qualified minorities, as part of the university's affirmative action program. Minorities should be allowed to go to school especially medical school because there has been a long ongoing exclusion of blacks from the medical profession. Minorities never have gotten a good education because of white inferiority and this is our chance to end that. There was no intention to exclude anyone because of race and it was actually the complete opposite. We are treating all races with equal respect and giving minorities the education they deserve, but have never got.  We are giving seats to those who deserve it. We are by no means violating anyone’s rights, we are simply integrating the schools. It was decided that the use of race as a criteria for admissions decision was constitutionally permissible and should be allowed based on their background of oppression and lack of education due to prejudice.
